New Delhi: The Centre on Thursday against dilution of Section 377 of Indian Penal Code (IPC) of the Delhi High Court, which decriminalized sexual acts, in private, between consenting adults and urged the Supreme Court to reverse the landmark ruling. The UPA government has said the Supreme Court that the HC has erred because a vast section of Indian society still considered homosexuality immoral.
The Delhi High Court on July 2, 2009, has delivered a historic judgment to change a 149-year-old colonial-era law - Section 377 of the IPC - and decriminalize private consensual sex, among the elderly both sexes. The judgment is seen as the biggest success yet for gay rights.
Gay sex "is totally immoral and against the social order," additional solicitor general PP Malhotra, representing the Centre, said the top court on Thursday.
He added that it is "against nature and spread HIV."
Centre said the ban favored the maintenance of the area to prevent child abuse and because Indian society is largely against homosexuality according to a survey by the Law Commission, Malhotra explained. "Law can not be run separately from society and the tendency of the time," she said.
When the Supreme Court asked to decide what is bad, the government of the Union said society so and argued that the Indian law can not but reflect the views of his society. The government said the HC considered only the judgment of the foreign country where homosexuality can not be resented.
"Our moral and social values are different from other countries and we can not be guided by them, 'Centre told the court.
Therefore, appealed provisions will remain in full to reflect the view of society. Centre is not even appealed against the judgment, the ministry activities of the Home came strongly against the dilution of Section 377.
The Union home ministry, however, denied that it has taken any position on homosexuality.
